These General Terms and Conditions (hereinafter referred to as “Terms”) govern the rights and obligations of the Seller and the Buyer in connection with the purchase of goods through the e-shop www.baterix.sk

Information

All information about goods and prices published on the website is binding, except for obvious errors.

Prices are stated including VAT and all applicable fees, excluding shipping costs.

The Seller is obliged to respond to written or electronic correspondence from the Buyer without undue delay, no later than within two business days.

Bank transfer with deferred due date (only for customers with approved credit).

Cash on delivery to the courier (GLS or Seller’s own delivery).

The Seller does not charge any additional fees depending on the method of payment.

Definition of Terms

Buyer (Consumer): A natural person who does not act within the scope of business activity or independent professional activity when concluding and fulfilling a contract.

Entrepreneur: A person acting within business or professional activity when concluding and fulfilling a contract.

Seller: For the purposes of these Terms, Trimark s.r.o. acts as the Seller and entrepreneur.

Delivery of Goods

An order is created by the Buyer on the Seller’s e-shop by adding selected products to the cart, filling in contact details, and confirming by clicking “Order with obligation to pay”.

The Seller confirms the order by email, attaching a summary and these Terms.

Goods in stock are dispatched within 2 business days. Maximum delivery time is 15 days unless otherwise stated.

The Buyer is obliged to accept and pay for the goods. Risk of damage passes to the Buyer upon receipt.

If the Seller fails to meet the delivery deadline, goods will be delivered free of charge and the Buyer will receive a 5% discount.

Order Cancellation and Withdrawal

The Buyer may withdraw from the contract within 21 days of receiving the goods without giving a reason.

Goods must be returned complete, preferably in the original packaging.

Return costs are borne by the Buyer. Goods cannot be returned by COD (cash on delivery).

Refunds will be issued within 14 days in the same way payment was received.

Exceptions (no right of withdrawal applies for):

Custom-made goods or goods tailored to the Buyer’s needs.

Perishable goods or goods with a short shelf life.

Sealed goods unsuitable for return for health or hygiene reasons if unsealed.

Audio/video recordings or computer software if the seal is broken.

Newspapers, periodicals, magazines (except subscriptions).

Digital content not delivered on a physical medium, if delivery has started with the Buyer’s consent before the withdrawal period ends.

Liability for Defects and Warranty

The Seller is liable for defects that occur within 36 months from delivery or within the period stated on packaging/documentation.

The Buyer may claim defects and request repair, replacement, a reasonable discount, or withdrawal if the defect is substantial.

Used goods may have a reduced warranty (minimum 12 months).

A presumption applies that defects discovered within 1 year of delivery already existed at delivery.

The Seller also provides a 36-month contractual warranty for selected products.

Complaints Procedure

Complaints must be filed without undue delay with a description of the defect and proof of purchase.

The Seller will confirm receipt of the complaint in writing.

Complaints will be processed within 30 days, unless agreed otherwise in writing.

For essential goods (e.g., prams, medical aids), complaints will be resolved within 20 days or a replacement will be provided.

If the complaint is justified, the Buyer is entitled to reimbursement of reasonable costs.

Personal Data Protection

The Buyer agrees that personal data provided will be processed by the Seller in accordance with the GDPR and Slovak legislation for the purpose of fulfilling the contract.

Data will not be shared with third parties except logistics partners (for delivery purposes).

The Buyer may at any time request information on stored data, correction, or deletion.

The Seller may send commercial communications only with the Buyer’s consent.

Dispute Resolution

Disputes will be primarily resolved amicably.

The Buyer may use the European ODR platform (https://ec.europa.eu/consumers/odr/
) for online dispute resolution.

In Slovakia, consumer protection is supervised by the Slovak Trade Inspection (SOI).

Return and Recycling of Electrical Equipment

The Seller ensures the take-back and recycling of old electrical devices, batteries, and accumulators in compliance with applicable Slovak and EU regulations. These items must not be disposed of with household waste.

Final Provisions

Matters not covered by these Terms are governed by Slovak law, in particular the Civil Code and the Consumer Protection Act.

Any changes to these Terms must be in writing.

These Terms are valid as of October 1, 2025.
